Terms and Conditions
Last updated: October 9, 2026
1. About These Terms
These Terms and Conditions (“Terms”) govern use of this website, including its content, contact forms, and related online features. The website is operated by New York Premier Landscapes, Inc., known as New York Decks and Premier Landscapes (“we,” “us,” or “our”). References in these Terms to the “website” include its pages and online features.
Please read these Terms before using the website. By using the website, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please stop using it. Nothing in these Terms limits rights or remedies that applicable law does not allow to be waived.
2. Service Area and Website Purpose
We perform work only within New York City. The website provides information about our outdoor design, construction, landscaping, and maintenance services, showcases selected projects, and allows people to contact us or inquire about employment.
Website descriptions do not guarantee that a particular service, material, design, appointment, or project date is available. Availability and suitability depend on the project, site conditions, required approvals, and our capacity.
3. Eligibility and Authority
The website is intended for adults. You must be at least 18 years old to request services or submit an employment application through the website. If you contact us on behalf of a property owner, building, company, or another person, you must have authority to provide the submitted information and make the inquiry. A request to discuss a project does not establish authority to approve work or bind a property owner.
4. Inquiries, Consultations, and Estimates
Submitting a form, requesting a consultation, or exchanging preliminary communications does not by itself create a project contract, reserve a start date, or authorize us to begin work. We may need additional information, a site visit, and review of project requirements before providing a proposal.
Any preliminary budget or timeline is subject to its stated assumptions and conditions. A written estimate or proposal is governed by its own wording, acceptance requirements, and any stated expiration date. Scope, site conditions, material selections, access, permits, and other project factors may affect pricing or timing. Any agreed project changes must be handled through the applicable project agreement and legally required documentation.
5. Separate Project Agreements
Design, construction, landscaping, maintenance, and other paid services are governed by a separate written agreement and applicable law. That agreement should address the relevant scope, pricing, payments, scheduling, responsibilities, approvals, change orders, warranties, and cancellation or termination terms.
These website Terms do not replace or amend a signed project agreement. If there is a conflict concerning project services, the applicable written project agreement controls, subject to mandatory law. These Terms do not establish a nonrefundable deposit, cancellation fee, payment schedule, or waiver of statutory cancellation rights.
Where home improvement laws apply, the required contracts, notices, disclosures, and change orders must be provided separately. Nothing on this page transfers legally imposed contractor duties to a client or eliminates any applicable licensing, permit, safety, or consumer protection requirement.
6. Project Information and Site Requirements
When discussing a project, please provide accurate information about the property, your role, desired work, and known conditions relevant to the inquiry. Before work begins, the project agreement should identify responsibilities for site access, building or owner approvals, permits, professional reviews, and other requirements as applicable.
Website content is general information. It is not a site-specific structural assessment, engineering opinion, architectural plan, legal opinion, or permit approval. Do not use website photographs or descriptions as construction instructions or as confirmation that a design is suitable for another property. Appropriate site assessment and professional review may be necessary.
7. Portfolio Images and Project Examples
Project photographs, descriptions, testimonials, and design examples illustrate selected work or experiences. Each site is different, and examples do not promise identical results, pricing, installation times, plant performance, or material appearance for another project.
Colors and finishes can appear differently on screens and in different lighting. Natural materials and plants can vary and change over time. Final selections, specifications, performance commitments, and any applicable warranties should be addressed in the project documents.
8. Intellectual Property and Permitted Use
Website text, photographs, graphics, logos, designs, and other original content are owned by us or used with permission from their respective owners and are protected by intellectual property laws. Third-party names and marks belong to their respective owners.
You may view the website and print or save reasonable excerpts for personal reference or to evaluate our services, provided you retain applicable ownership notices. Except as permitted by law or with the rights holder’s written permission, you may not reproduce, sell, redistribute, modify, or use website content commercially, or present it as your own work. These Terms do not grant rights to our branding, project plans, or proprietary designs.
Ownership and permitted use of drawings, plans, deliverables, and other materials created for a client project are governed by the applicable project agreement.
9. Materials You Submit
You remain responsible for information, photographs, plans, resumes, and other materials you submit. You must have the necessary rights or permission to provide them and must not submit unlawful, misleading, infringing, or malicious content.
You retain ownership of your submitted materials. You permit us to use, copy, and share them with relevant personnel and service providers as reasonably necessary to review and respond to your inquiry, assess an application, or discuss and administer requested services, consistent with our Privacy Policy and any applicable agreement.
Submitting materials does not give us a general right to publish them for advertising. Any promotional use of client project materials is subject to applicable permissions and agreements. Please do not send passwords, Social Security numbers, payment card details, or unnecessary sensitive information through general contact forms. If confidentiality requirements apply to proposed project materials, arrange the appropriate terms before submitting them.
10. Acceptable Website Use
You may use the website only for lawful purposes. You must not:
- Impersonate another person or misrepresent your identity, affiliation, or authority.
- Submit spam, threats, harassment, malicious code, or material that infringes another person’s rights.
- Attempt unauthorized access to systems, interfere with security controls, or disrupt website operation.
- Use automated tools to overload the website or collect personal information without authorization.
- Use our content or branding to suggest an endorsement or affiliation that does not exist.
We may restrict access or decline abusive or unlawful submissions as reasonably necessary to protect the website, our business, or others.
11. Privacy and Communications
Our Privacy Policy explains how we handle personal information, cookies, analytics, advertising technologies, and privacy requests. Please review it when submitting information.
If you contact us, we may respond using the contact details you provide about your inquiry, application, or project. Submitting an inquiry is not blanket consent to unrelated promotional calls or text messages. Marketing communications and any required consent are handled in accordance with applicable law. You may contact us to request that promotional communications stop; necessary project or administrative communications may continue.
12. Employment Inquiries
Job descriptions and employment information are informational and may change. Submitting an application does not guarantee an interview, offer, or employment relationship. Any offer and employment terms are established separately. Nothing in these Terms limits rights under applicable employment law.
13. Third-Party Links and Features
The website may link to external websites or include third-party features such as maps, embedded media, or social media links. Those services are operated by their respective providers and may have separate terms and privacy policies. A link alone does not imply endorsement. We do not control independent third-party content or availability.
14. Website Availability and Corrections
We may update, change, suspend, or discontinue website content or features. We aim to provide useful, accurate information, but the website may contain errors or outdated material. Please contact us to confirm information important to a project or decision. Corrections to website content do not by themselves change a signed project agreement.
We do not guarantee uninterrupted access, error-free operation, or that the website will always be free of harmful components. Use appropriate security precautions when browsing or downloading materials.
15. Website Warranty Disclaimer
To the extent permitted by applicable law, the website and its general informational content are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement.
This disclaimer applies to the website. It does not disclaim express promises in a project agreement, applicable workmanship or product warranties, or statutory rights and protections that cannot lawfully be excluded.
16. Limitations of Liability
To the extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the website, including lost profits or loss of data.
This limitation concerns website use and does not limit obligations or remedies under a separate project agreement. Nothing in these Terms excludes liability for fraud, gross negligence, willful misconduct, or any liability that applicable law does not permit to be excluded or limited. Where a limitation is not permitted, it applies only to the extent allowed by law.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of New York and applicable federal law, subject to any mandatory protections that apply. For disputes relating to these website Terms, courts with jurisdiction in New York City are the designated forum to the extent permitted by applicable law.
Please contact us first so we can try to resolve a concern. This request does not prevent you from pursuing available legal remedies, filing a regulatory complaint, or meeting a filing deadline. These Terms do not require arbitration or waive jury trial, class action, or small claims rights. Dispute provisions in a separate project agreement are governed by that agreement and applicable law.
18. Changes to These Terms
We may revise these Terms and will post the updated version and date on this page. Revisions apply prospectively to website use after their effective date, to the extent permitted by law. Where additional notice or agreement is legally required, we will provide it. Website revisions do not retroactively change a signed project agreement or accrued rights.
19. General Provisions
If a provision is held invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive the right to enforce it later. Provisions concerning intellectual property, disclaimers, liability, and dispute resolution continue to apply to relevant conduct after website use ends.
These Terms address website use. They do not supersede separate project, confidentiality, employment, or other written agreements. Section headings are for convenience.
